These Terms & Conditions apply to all purchases of digital photographs offered through this website.

By placing an order, the customer agrees to these Terms & Conditions.

Products 

The products offered on this website are digital photographic files intended for use as wallpapers on personal devices.

No physical products will be shipped.

Conclusion of Contract

A contract is concluded when the customer completes the purchase process and payment has been successfully received.

Prices and Payment

All prices displayed on the website are final prices.

No VAT is charged in accordance with § 19 UStG (German small business regulation).

Payment is made using the payment methods offered on the website, in particular PayPal.

Delivery

After successful payment, the purchased digital file is made available for immediate download.

The customer is responsible for ensuring that their device is capable of downloading and displaying the file.

License Grant

Upon purchase, the customer receives a non-exclusive, non-transferable, worldwide and perpetual license for personal, non-commercial use of the purchased image.

Ownership and copyright remain exclusively with the photographer.

Copyright

All photographs offered on this website are protected by copyright law.

The purchase of a photograph does not transfer any copyright or intellectual property rights to the customer.

Prohibited Uses

The customer may not:

• resell the image;
• distribute the image to third parties;
• sublicense the image;
• use the image for commercial purposes;
• publish the image for download by others;
• upload the image to stock photography platforms;
• use the image for advertising or marketing;
• use the image for AI training, machine learning datasets, or similar technologies;
• create NFTs or blockchain-based assets from the image;
• claim authorship of the image.
• share the original file with other persons
• sell printed versions of the image  

Limitation of Liability

The digital files are provided “as is”.

The seller shall not be liable for indirect damages, loss of data, loss of profits, or technical incompatibilities beyond the seller’s control.

Applicable Law

These Terms & Conditions shall be governed by the laws of the Federal Republic of Germany.

If any provision of these Terms & Conditions is found invalid, the remaining provisions shall remain unaffected.
